* How it works: To file a
complaint with the city, tenants must first tell their landlords in
writing about problems and give them 10 days to correct. If not
corrected, a complaint must be in writing and may be filed in person or
by mail or fax.
A person who files a complaint must be a party to the current rental
agreement covering the property in question or an agent of the party.
A complaint must include:
Name of the person filing the complaint and, if different,
the name of the affected tenant. Complaints may not be submitted
anonymously;
Name of the owner or the owner’s agent;
Address of the dwelling unit;
Complete description of the alleged
violation; and
A copy of the written notice that was sent by the
tenant to the owner or the owner’s agent.
The
city manager may enter the premises at reasonable times to inspect
the premises, provided that if the premises is occupied, credentials
must be presented to the occupant and entry requested. If the premises
is unoccupied, the city manager must first make a reasonable effort to
locate the owner, the owner’s agent, or other person having charge of
control of the premises and request entry. If entry is refused by the
owner, the city manager will have recourse to every remedy, including
issuance of administrative search warrants. If entry is refused
by the tenant, the complaint may be dismissed and the case closed.
The city will provide 24-hour notice to the owner or owner’s agent
prior to a scheduled inspection of the premises in order to afford them
the opportunity to be present during the inspection.
The
city collects an annual fee of $10 per rental unit from landlords to
cover the cost of inspections.
8.425
Rental Housing - Standards
(a) Roof, exterior walls, windows and doors shall be maintained to
prevent water leakage into living areas which may cause damage to the
structure or its contents or may adversely affect the health of an
occupant.
(b) Repairs must be permanent rather than temporary and shall be
through generally accepted construction methods.
