SB      855 Directs State Treasurer to transfer $112,000,000 from Education Stability Fund  to State School Fund. Makes finding that economic and revenue forecast conditions required by  Oregon Constitution to make transfer have been met. Allows State Treasurer to divert funds from and reduce amount of funds in  accounts in Education Stability Fund for purposes of making transfer. Declares emergency, effective on passage. SB 856 Authorizes State Treasurer to issue revenue bonds to be paid from  appropriated moneys and other moneys legally available. Specifies that  bond proceeds are to be credited to General Fund. Repeals Master Settlement Asset Corporation Act. Declares emergency, effective on passage.

SJR    1 Proposes amendment to Oregon Constitution to allow issuance of state general  obligation bonds for deferred maintenance, modernization and equipping of  educational buildings and structures of Oregon University System. Limits amount to be loaned and  indebtedness incurred to $500 million. SJR    3 Proposes amendment to Oregon Constitution to establish political  limits. Prohibits direct contributions and expenditures by corporations and labor  organizations. Allows corporations and labor organizations to establish  separate segregated funds to be used for political purposes. SJR    7 Proposes amendment to Oregon Constitution to increase amount of state  general obligation bonds for higher education projects that may be issued  each dollar appropriated from General Fund. SB 240 Allows State Board of Higher Education to issue general obligation bonds to  provide funds for deferred maintenance, modernization and equipping  educational buildings and structures of Oregon University System. Limits  amount of bonds that may be issued in 2003-2005 biennium to $___. Takes effect only if constitutional amendment proposed by Senate Joint  Resolution 1 (2003) is approved by people at special election to be held  same date as next primary election. SB 329 Permits Governor to declare state of financial emergency under  conditions, suspend pay increases to state government and school employees, suspend certain terms of collective bargaining agreements and services contracts and take other actions. Does not apply to elected officials  whose salaries are fixed by law. Declares emergency, effective on passage.

SB 427 Requires public employers to provide paid health care insurance coverage to  retired public safety employees until retired employees are eligible for Medicare  coverage. REFERRED TO SENATE HUMAN RESOURCES

SB 437 Modifies provisions relating to Oregon University System regarding academic  degree programs, delegation of duties, functions and powers, information  technology, legal services, funds and accounts, property, public records and employee benefit plans. SB 5538 Limits biennial expenditures from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected  or received by Public Employees Retirement System.   Excludes from expenditure limitation  expenditures for refunds, retirement benefits, health insurance premiums and premium subsidies, Public  Employee Benefit Equalization Fund payments and deferred compensation  payments. HB 2001 Prohibits Public Employees Retirement Board from crediting accounts of  One members with earnings in excess of assumed interest rate until certain  conditions are met. HB 2002 Directs Oregon Investment Council to separately invest moneys in  Employees Retirement Fund that are attributable to regular accounts of Tier  members of Public Employees Retirement System, regular accounts of Tier  members, retiree reserves and all other moneys in the fund. Directs Oregon  Investment Council to select investments for each category that are most  to minimize effect of investment volatility on pension liabilities, thereby promoting  goal of ensuring actuarially sound system and greater predictability in benefits  and costs of providing benefits. Directs Public Employees Retirement Board to consider only  selected by the Oregon Investment Council for moneys attributable to regular  accounts of Tier One members in establishing assumed interest rate for those  moneys. HB 2003 Revises laws relating to Public Employees Retirement System. Declares emergency, effective on passage.

HB 2004 Requires that Public Employees Retirement Board adopt mortality tables, based  on best available actuarial information, every two years for purpose of  computing benefits of members and beneficiaries of members. Provides that mortality tables first become effective on January 1,  2005. Specifies method of determining benefits for retirees and other beneficiaries  or after July 1, 2003, and before January 1,  2005. Confers jurisdiction on Supreme Court to determine constitutional issues relating  to implementation of Act. HB 2005 Reduces membership of Public Employees Retirement Board from 12 to five  members. HB 2006 Requires Public Employees Retirement Board to establish separate deficit  account for each year in which regular accounts of Tier One members of Public Employees Retirement System are credited with earnings at assumed interest rate and Public Employees Retirement Fund does not earn assumed interest  rate. Prohibits maintaining deficit for more than __ years. Requires that deficit be  paid at end of __-year period. Provides that amount of deficit be paid  from employer and employee contributions. HB 2007 Provides that if person is vested member of Public Employees  System and is absent from public employment for more than five consecutive  years, person is entitled only to benefits in effect on date of reemployment for  subsequent service with participating public employer. HB 2008  Establishes Public Employee Successor Retirement Plan for persons hired on or  after January 1, 2004, who have not established membership in Public  Employees Retirement System before January 1, 2004. HB  2328 Eliminates limitation on number of hours that retired member of Public Employees  Retirement System may be employed while receiving service allowance. Allows  retired member to elect to become active member upon reemployment. REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB 2345  Limits proceeds from and issuance of general obligation bonds during  2003-2005 biennium. Limits proceeds from and issuance of direct revenue bonds and pass through  revenue bonds during 2003-2005 biennium. Allocates amounts to various agencies for private activity bonds. HB 2375  Provides that person who establishes membership in Public  Retirement System on or after effective date of Act has no contract rights in  system. Declares emergency, effective on passage. REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB 2400 Allows active or inactive member of Public Employees Retirement System to  transfer amounts credited to member in Public Employees Retirement Fund to  any new defined contribution plan established by Legislative Assembly  January 1, 2003.  Provides that upon transfer by member, Public Employees  Retirement Board transfers to credit of member under new plan  amount equal to __ percent of account, to be paid from employer contributions. Specifies that member making transfer is entitled only to benefits provided under REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB 2404 Repeals benefit increases under Public Employees Retirement System enacted  to compensate members of system for state income tax on benefits  system. Exempts from state income taxation those benefits received from  system that are attributable to employment occurring before October 1, 1991. Takes effect on 91st day following adjournment sine die. HB 2408 Prohibits active membership in Public Employees Retirement System on and after  January 1, 2004. Provides that person who is active member of system on  December 31, 2003, be treated in manner provided by law for inactive  members. Directs Public Employees Retirement Board to continue to administer system for  benefit of inactive and retired members. Provides for direct petition to Supreme Court for review of constitutionality of  Act.  REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB 2421 Allows public employer participating in Public Employees Retirement System to  employ retired member of system for period not to exceed five years without  limitation on number of hours worked by retired member in calendar year Requires that retired member contribute six percent of salary for deposit to  employer reserves. Prohibits employer contributions for retired members  employed. Limits number of retired members that may be employed to 10  percent of all employees of public employer. HB 2582 Sets limits on amounts that may be contributed to political candidates. Requires  filing of statement by person making certain independent expenditures. Modifies  definition of independent expenditure.  Becomes effective if amendment to Oregon Constitution allowing regulation of  campaign contributions is approved by people at next primary election. HB 2628 Establishes Portland State University as public corporation under control of  Portland Metropolitan Universities Board of Directors. Removes Portland State University from Oregon University System. Changes name of Oregon Health and Science University Board of Directors to  Portland Metropolitan Universities Board of Directors. Becomes operative July 1, 2004. REFERRED TO HOUSE EDUCATION

HB 2633 Prohibits Public Employees Retirement Board from crediting accounts of new  members with earnings in excess of four percent. Declares emergency, effective on passage. REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB 2745 Requires Governor's proposed budget to include unobligated amount not less   five percent of General Fund revenues from preceding biennium. REFERRED TO HOUSE WAYS AND MEANS

HB 2795 Requires employment agreement for public employee to fix maximum amount  employer will pay toward compensation plan. Requires employer to reduce  amount it pays for one or more items of compensation plan when another item  of compensation plan increases in cost. Applies to employment agreements entered into on or after effective date of

HB 2930 Prohibits salary increases for state employees under certain economic and  state revenue conditions. Requires eligible state employees to pay 25 percent of  cost of selected health benefit plan. Prohibits public employer from agreeing  'pick-up, ' assume or pay employee contributions to Public Employees Retirement  System for persons who establish membership in system after effective date  of Act. Declares emergency, effective on passage.

HB  2931 Provides that position in executive department that is vacant for four months is  abolished. Specifies that allotment for agency is reduced.

HB 3020 Provides rules for distribution of member account of member of Public  Employees Retirement System who dies before retiring. Requires payment to  personal representative or person filing small estate affidavit if member has not designated beneficiary. Provides that  death benefits and other amounts under system do not escheat to state. Increases from $30 to $200 minimum amount that may be paid as monthly  payment to beneficiary of deceased member in lieu of lump sum payment.

HB 5027 Appropriates moneys from General Fund to Oregon University System for  certain biennial expenses and for debt service on general obligation bonds sold  to support higher education institutions. Limits biennial expenditures from fees, moneys or other revenues, including  Miscellaneous Receipts, but excluding lottery funds and federal funds, collected  or received by system. Limits biennial expenditures from funds allocated to system from Sports Lottery  Account. Limits biennial expenditures of system from lottery moneys for debt service on  lottery bonds. Excludes from expenditure limitation expenditures for gift, grant and contract  activities, noncredit continuing education, auxiliary enterprise activities, user fee  supported education and public service activities, student aid programs and  debt service on bonds sold pursuant to Article XI-F(1) of Oregon Constitution. HB 5028 Appropriates moneys from General Fund to Department of Higher Education for  capital construction. Limits for six-year period beginning July 1, 2003, payment of expenses from  proceeds of bonds and other revenue sources, including federal funds, collected or received by Department of Higher Education for capital construction. Sets expiration date on project approvals and expenditure limitations. REFERRED TO HOUSE WAYS AND MEANS SUBCOMMITTEE ON EDUCATION

HB 5042 Appropriates moneys from General Fund to Oregon Department of  Administrative Services for Oregon Health and Science University. Declares emergency, effective July 1, 2003. REFERRED TO HOUSE WAYS AND MEANS SUBCOMMITTEE ON EDUCATION

SJR 25 Proposes amendment to Oregon Constitution to require Legislative Assembly in  regular session to retain ending balance of at least two percent of projected  General Fund revenues. Refers proposed amendment to people for their approval or rejection at next  regular general election.

SJR 26 Proposes amendment to Oregon Constitution to require two percent of General  Fund be retained, unexpended, in General Fund.   Refers proposed amendment  to people for their approval or rejection at next regular general election.

 

SJR    28 Proposes amendment to Oregon Constitution to establish separate revenue  forecasts for General Fund revenue derived from personal income taxes  imposed on taxable net capital gain and corporate income and excise taxes  imposed on taxable net capital gain. Directs that, if actual collections from these  sources exceed estimates by two percent or more, excess amounts be  transferred to education stability fund. Refers proposed amendment to people for their approval or rejection at  regular general election.

SB 186 Directs State Board of Higher Education to establish exemptions from  competitive procedures adopted by board for purchasing, procurement and  contracting of goods and services. Declares emergency, effective on passage. REFERRED TO SENATE EDUCATION

SB 323 Modifies requirements for membership of part-time employees in Public  Employees Retirement System. Requires that position of part-time employee  must normally require 1,040 hours of service in calendar year to  employee for membership in system. Applies only to employees who establish  membership in system on or after effective date of Act. Declares emergency, effective on passage. REFERRED TO SENATE GENERAL GOVERNMENT

SB 346 Provides for certification to Supreme Court of appeal of certain actions in whichone or more cities or counties are plaintiffs, State of Oregon is defendant and appeal relates to decision of trial court on one or more claims challenging manner in which Public Employees Retirement System is administered. Declares emergency, effective on passage. REFERRED TO SENATE GENERAL GOVERNMENT

SB 358 Directs community colleges, state institutions of higher education and Oregon  Health and Science University to promote commercialization of research and ideas. Allows State Board of Higher Education to establish competitive procedures for purchasing, procurement and contracting of technology, and exemptions from those procedures. SB 363Allocates funds from Administrative Services Economic Development Fund to Department of Higher Education for activities under interagency agreement between Economic and Community Development Department and Higher Education Technology TransferFund Board. SB 509 Contingent on interstate agreement, directs State Board of Higher Education and  Oregon Health and Science University Board of Directors to consider  Washington residents to be residents of Oregon for purposes of determining  REFERRED TO SENATE EDUCATION

SB525 Broadens class of members of Armed Forces of United States who are eligible  for resident tuition rates at state institutions of higher education to include  members who serve in another state and file Oregon state income taxes. Moves definitions of members of Armed Forces of United States to statutes that  provide benefits related to tuition at community colleges and certain activities of  State Fish and Wildlife Commission. Declares emergency, effective July 1, 2003. REFERRED TO SENATE EDUCATION

SB570 Provides that for purposes of full formula calculation of Public Employees  Retirement System retirement allowance, teachers and certain other employees  in education-related employment receive full one-half year of membership for periods during which school  other institution is in session, without regard to when session commences or  REFERRED TO SENATE GENERAL GOVERNMENT

  SB662 Permits public employee who choo ses not to be member of union to  amount of money equivalent to union dues to charity of employee's choosing including religious charity, provided charity meets certain requirements. REFERRED TO SENATE GENERAL GOVERNMENT

SB750 Allows public employer participating in Public Employees Retirement System to  employ retired member without limitation on number of hours worked during  calendar year if member is employed to temporarily replace employee who  serves in National Guard or reserve component of Armed Forces and who is  called to federal active duty. HJR 11 Proposes amendment to Oregon Constitution specifying that Legislative  Assembly, or people through initiative process, may enact laws limiting or  prohibiting certain contributions made to candidates for public office. HB2323 Provides that appropriation is direction to spend amounts appropriated in budget  unless agency can fulfill responsibilities with less. Requires that reductions in allotments to reduce deficit be made according to  legislative priorities, with presumption that all General Fund appropriations have  equal priority and allotments should be reduced by equal percentage. HB 2401 Allows Public Employees Retirement Board to deduct costs incurred in  former member of Public Employees Retirement System from amounts in  account of former member. Increases amounts required to be paid for certain full-cost service purchases to  include administrative expenses incurred by system in processing application  for purchase. Authorizes board to establish procedures for recovering administrative costs  from members for services provided in estimating retirement benefit amounts  and processing payments if board determines that services requested by individual member result in  extraordinary costs to system. Allows board to recover interest, attorney fees and other costs when overpayment or erroneous payment is made to member and board determines  that overpayment or erroneous payment was not caused by system or by participating public employer. HB 2402 Allows public employers other than state to withdraw from Public Employees  Retirement System. Provides that person employed by withdrawing public  employer who is active member of system on effective date of withdrawal  ceases to be active member and thereafter is treated in manner provided by law for inactive members. Specifies  that withdrawal of public employer does not affect right of member to benefits  that have accrued as of effective date of withdrawal. HB 2635 Allows active member of Public Employees Retirement System to withdraw all  amounts credited to member in Public Employees Retirement Fund. Allows  withdrawal only if amounts withdrawn are paid directly into qualified retirement  plan that is able to accept amounts as pretax rollover. Provides that person making withdrawal ceases to be member of system,  forfeits all membership rights and may not thereafter become member of  system. Authorizes public employer that employs withdrawing member to enter  into agreement that provides for payment of contributions by public employer to alternate retirement plan. HB 2636 Provides that specified percentage of agency's General Fund balance that is  unobligated at end of biennium may be distributed to employees. Provides that   stays with agency. REFERRED TO HOUSE GENERAL GOVERNMENT

HB 2723 Directs Public Employees Retirement Board to develop and implement  Retirement Option Plan. Provides that member of Public Employees Retirement  System may participate in plan for not more than four years after retirement.  Specifies that member participating in plan is not subject to 1,040-hour limitation  on post-retirement employment. Provides that member contributions that would otherwise be made to system be  paid into plan account established for member. Specifies manner in which account is invested and distributed. Requires employer with equal to or better plan to establish equivalent program. REFERRED TO HOUSE PUBLIC EMPLOYEES RETIREMENT SYSTEM

HB2762 Requires public body to conduct collective bargaining in public. Requires public body to notify public of collective bargaining. Authorizes resident of public  body's jurisdiction to bring civil action for violation or on application of Act.  Authorizes Oregon Government Standards and Practices Commission to  penalize public official for violating Act. HB2883 Appropriates moneys from General Fund to Department of Higher Education for  certain activities of Oregon State University Extension Service. Declares emergency, effective July 1, 2003.

HB2929 Modifies minimum amount of aggregate political contribution for which name and  address of person making contribution must be reported. Deletes requirement  that occupation of contributor be reported. Sets minimum aggregate amount for  which name and address of person making in-kind contribution must be  reported. Prohibits publishing signatures contained in election documents on Internet. Modifies procedures for examination by filing officers of contribution and

HB2949 Removes limit on number of hours retired member may work and still qualify  retirement under Public Employees Retirement System if retired member is  employed by school district or education service district as other than teacher or management employee, or by  community college as other than management employee or faculty member.

HB2978 Reduces time from 150 days to 75 days for bargaining over terms of public employee collective bargaining agreement. Reduces time from 90 days to 45  days for expedited bargaining process.

HB2979 Prohibits public employer from providing merit step and longevity step pay  increases after collective bargaining agreement has expired and before agreement on successor contract.

SB 338 Creates Expanded Options Program for students attending public schools  grades 11 and 12 or who are 16 years of age or older. Directs resident school district to enter into agreement with institution for  limited payment of costs from State School Fund grant of school district. Specifies that plan must provide members of voluntary employees'  beneficiary associations with individual health care expense trust accounts to  pay qualified health care expenses of members and dependents of members. Requires that public employer participating in plan allow members to  designate number of hours of member's unused vacation leave and sick leave  that will be automatically converted each pay period to employer contributions to member's health care  expense trust account. Provides limits for number of hours that may be  converted. Provides procedure for forming voluntary employees' beneficiary associations  for purpose of participation in plan. SB 800 Directs Oregon Health and Science University to award grants to  post-secondary institutions to expand capacity of nursing education programs Establishes Oregon Nursing Shortage Coalition Committee to adopt criteria for  awarding grants.
